DIGITAL SIGNATURE AND DIGITAL SALARY RECEIPTS



It is a safe and reliable technological tool which allows to identify a document signatory and whether said document was falsified. It consists of a unique sequence of letters and numbers that link a signatory with an electronic document.

DIGITAL SIGNATURE: WHAT FOR?

It facilitates the replacement of paper documentation for its equivalent in digital format. As a cost-saving tool, it simplifies procedures and provides security in the exchange of information.

LEGAL VALIDITY



Electronic documents bearing a digital signature are as legally valid as those hand-signed.

•      Section 3 of Law 25.506
“When a document needs to bear a handwritten signature, a digital signature is valid as well.”
•      Section 288 of the Argentine Civil and Commercial Code
“Electronic documents where a person’s signature is requested can be digitally signed every time the document’s author and integrity are undoubtedly ensured.”




DIFFERENCES BETWEEN ELECTRONIC AND DIGITAL SIGNATURES


There is a GENDER AND SPECIES RELATIONSHIP between the electronic and the digital signatures: all digital signatures are electronic but not all electronic signatures are digital.

DIGITAL SIGNATURE:

    ✓    Complies with the signature requirement.
✓    Is guaranteed by a digital certificate issued by an Authorized Certifier.
✓    Unless proven otherwise, any digital signature is deemed issued by the holder of the digital certificate which allows its verification (Section 7 of Law 25.506).

ELECTRONIC SIGNATURE:

    ✕    Does not comply with the signature requirement.
✕    Is not guaranteed by a digital certificate issued by an Authorized Certifier.
✕    Authorship is not proven. Whoever intends to assert the authorship of an electronic signature must prove it.

DIGITAL SALARY RECEIPTS

By means of Resolution N° 346/2019 the Ministry of Production and Work ruled that employers can issue either digital or paper salary receipts to their employees.

REQUIREMENTS


REQUIREMENTS

    ✓    The receipt must comply with sections 138, 139 and 140 of the Argentine Labor Law N° 20.744, text issued in 1976 as amended, and by Law N° 25.506 as amended.
✓    The company shall deliver all necessary means for both the employer and the employee sign the receipt digitally (electronic signature is not permitted).
✓    Workers shall have the possibility to sign in opposition.
✓    The system will permit the workers to save a copy of their digital salary receipts.
✓    No authorization from the Ministry of Production and Work is required.
